1985-2021
ADVANCED PRACTICE CLINICIANS
The MPL Association Data Sharing Project has compiled 1,626 closed claims and lawsuits involving Advanced Practice Clinicians (APCs) between 1985 and 2021. Notably, the number of claims for APCs has been rising steadily over five-year intervals within this timeframe. It’s worth mentioning that claims closed between 2020 and 2021 were separated due to COVID-related court restrictions. This highlight will focus on average indemnity, resolution outcomes, and allegations in claims involving APCs.

 

 

 

 

Examining the severity of claims from 2015-2019, in 76% of closed claims no liability was attributed to the APC. In 20%, settlements were reached, while 3% were resolved through alternative dispute resolution methods or contract liability agreements. Additionally, 1% were resolved through early offers, and less than 1% resulted in a favorable outcome for the plaintiff.

 

Diagnostic
Diagnostic errors were pinpointed as the main allegation in each APC category, except for CRNA, where the percentages were as follows: CNM-40% (tied with procedural errors), NP-55%, and PA-40%.
Procedure
Procedural errors were the primary allegation in CRNA (55%) and CNM (40%-tie with diagnostic errors) claims. In contrast, procedural errors were secondary to other APCs, with percentages as follows: NP-19% and PA-35%.
Medication
Medication errors accounted for 13% of NP claims and 9% of PA claims.
